  • Independent Parties: Witnesses must be mentally competent adults who are completely independent of the transaction.
  • No Financial Interest: They cannot be named as beneficiaries, executors, or trustees anywhere in the documents.
  • No Direct Relatives: To ensure long-term validity in probate court, witnesses should not be related to you by blood or marriage.
  • Valid Identification: Just like the signer, every witness must present a valid, government-issued photo ID at the appointment.

  • Clients Must Secure Witnesses: SWFL Signatures does not provide or bring witnesses to appointments. It is the client’s sole responsibility to have both witnesses present when the notary arrives.
  • Appointments Cannot Proceed: If the required legal witnesses are not present at the scheduled time, the notarization cannot legally take place, and a travel fee will still apply.
  • Hospital & Facility Signings: Please note that medical staff at local SWFL hospitals and assisted living facilities are typically restricted by corporate policy from acting as legal witnesses. You must arrange for outside witnesses to meet us there.
