  • Mentally Competent Adults: Witnesses must be at least 18 years old and possess a valid, government-issued photo ID (Driver’s License or Passport).
  • Independent Parties: To protect your estate plan from future probate contests or legal challenges, witnesses should be independent, non-related adults.
  • No Financial Interest: Witnesses should not be named as beneficiaries, executors, trustees, or agents anywhere in the estate documents.

  • Clients Must Provide Witnesses: SWFL Signatures does not provide or bring witnesses to appointments. It is the client’s sole responsibility to have both eligible witnesses present when the notary arrives.
  • Unfulfilled Appointments: If required witnesses are not present at the scheduled time, the notarization cannot legally take place, and a standard travel fee will apply.
  • Hospital & Care Facility Signings: Medical personnel and staff at local SWFL hospitals, hospice units, and assisted living facilities are strictly prohibited by corporate liability policies from witnessing patient legal documents. You must arrange for two outside adult witnesses to meet us on-site.
