Welcome to SWFL Signatures LLC. By accessing or using our website or services (including mobile notary, remote online notarization, and Live Scan fingerprinting services), you agree to these Terms and Conditions. Please read them carefully.
1. Acceptance of Terms
By using this website, you agree to comply with these Terms and Conditions, our Privacy Policy, and all applicable laws. If you do not agree, do not use our website or services.
2. Services Provided
SWFL Signatures LLC provides:
- Mobile Notary Services: In-person notarization at client-specified locations.
- Remote Online Notarization (RON) Services: Electronic notarization through secure, state-approved online platforms, including identity verification and video recording.
- Live Scan Electronic Fingerprinting: In-person digital fingerprint capture and secure electronic submission to the Florida Department of Law Enforcement (FDLE) and the FBI for state and federal background checks.
- We reserve the right to modify or discontinue any services at any time.
3. Legal Advice Disclaimer (UPL)
SWFL Signatures LLC and its operators are not attorneys. We are not licensed to practice law in the State of Florida. We do not provide legal advice, draft legal documents, or advise on the legal effects of any document. You are solely responsible for ensuring your documents are legally accurate and complete.
4. Right to Refuse Service
We reserve the right to refuse service, terminate an active session, or decline to perform services if:
- The identity of the signer or applicant cannot be legally verified.
- The signer appears confused, coerced, or lacks the necessary mental capacity.
- The transaction appears to be fraudulent, unlawful, or harmful.
- The client fails to provide required documentation, proper identification, or valid agency identifiers.
5. User Obligations
By using our services, you agree to:
- Provide accurate, complete, and current identification, documents, and information.
- Use our website and services legally and responsibly.
- Comply with all applicable local, state, and federal laws.
6. Fingerprinting and Background Check Disclaimers
- ORI Number Accuracy: Fingerprint applicants must provide the correct Originating Agency Identifier (ORI) number corresponding to their specific licensing, regulatory, or employment agency. SWFL Signatures LLC is not responsible for delayed, rejected, or lost background check results due to an incorrect or missing ORI number provided by the applicant.
- No Refunds on State Fees: Once fingerprints are captured and electronically transmitted to state agencies, all state and federal background check processing fees are non-refundable.
- Identification Requirements: Florida law requires applicants to bring two (2) valid forms of government-issued identification to their fingerprinting appointment. At least one must include a photograph and a signature.
7. Remote Online Notarization (RON) Specific Terms
Remote online notarizations are performed in compliance with Florida Statutes Chapter 117.
- Audio-Video Recording: By utilizing RON services, you explicitly consent to the audio-video recording of your session. We are legally required to retain this recording and an electronic journal for a minimum of ten (10) years.
- Identity Proofing: You must successfully pass credential analysis and identity proofing (such as Knowledge-Based Authentication) as mandated by Florida law to proceed with a RON session.
8. Payment and Fees
- Fees for notary and fingerprinting services are listed on our website or quoted individually.
- All fees, including travel fees, convenience fees, and online platform fees, must be paid as agreed.
- Payments are processed securely through third-party providers. Failure to pay may result in immediate suspension or cancellation of services.
9. Intellectual Property
- All content on this website, including text, logos, images, and software, is the property of SWFL Signatures LLC or its licensors.
- You may not copy, reproduce, or distribute content without written permission.
10. Limitation of Liability
- SWFL Signatures LLC is not responsible for damages resulting from use of the website or services, including errors, omissions, delays, or technical failures.
- While we take strict data safety precautions, we cannot guarantee the complete security of information transmitted online.
- Our maximum liability is strictly limited to the total amount paid for the specific service provided.
11. Dispute Resolution and Statute of Limitations
- These terms are governed by the laws of the State of Florida.
- Any legal claim or cause of action arising out of our services must be filed within one (1) year after the date the service was provided, or the claim is permanently barred.
