SWFL Signatures LLC (“we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your personal and biometric information when you use our website or services.
1.Information We Collect
We collect information necessary to perform notarial acts, execute Live Scan fingerprinting, and manage our business operations, including:
- Personal Identifiers: Name, email address, phone number, and physical address.
- Identification Documents: Photos or physical scans of government-issued IDs, driver's licenses, or passports (required for identity verification).
- Biometric Information: Digital fingerprint scans captured in person via Live Scan devices.
- Verification & Tracking Data: Knowledge-Based Authentication (KBA) results, credential analysis data, and Transaction Control Numbers (TCN) generated upon background check submission.
- Audio-Video Recordings: Full video and audio recordings of Remote Online Notarization (RON) sessions.
- Payment Information: Credit card or billing details (processed securely via third-party payment processors; we do not store full card numbers).
2. How We Use Your Information
- We use your data strictly to:
- Provide mobile notary, remote online notary, and Live Scan fingerprinting services.
- Verify your identity as required by Florida law and federal guidelines.
- Maintain an official electronic notary journal and video archive.
- Transmit fingerprint records securely to state and federal background check agencies.
- Process payments and send booking confirmations.
3. Data Retention and Deletion
- Notary Records (Florida Legal Mandate): In compliance with Florida Statutes Chapter 117, we are legally required to securely retain electronic notary journals and audio-video recordings of all RON sessions for a minimum of ten (10) years. This data cannot be deleted upon request prior to the expiration of this statutory period.
- Fingerprint Biometric Data: SWFL Signatures LLC does not permanently store or retain your raw digital fingerprint biometric data. Fingerprints are collected via an FDLE-approved Live Scan machine and securely encrypted and transmitted directly to the Florida Department of Law Enforcement (FDLE). Once transmission is successfully completed, the biometric data is automatically wiped from our local system.
4. Information Sharing
We do not sell, rent, or trade your personal or biometric information. We only share data with:
- State-approved RON platform providers used to conduct your online notarization.
- Authorized background check repositories (FDLE and FBI) for fingerprint processing.
- Secure third-party payment processors.
- Law enforcement or government officials, strictly when required by law or a valid subpoena.
5. Security
We implement industry-standard administrative, physical, and technical security measures to protect your data. However, no transmission over the internet or via electronic means can be guaranteed 100% secure.
